1About Margo Deliveries

Margo Deliveries is a food delivery platform owned and operated by Zae Food Private Limited, a company incorporated under the Companies Act, 2013, bearing CIN U10790MH2026PTC464599, with its registered office at Shop No. 9, MV Bhakti Mandir Road, Near Hariniwas Circle, Naupada, Thane (West), Thane – 400602, Maharashtra, India.

The platform enables users to browse menus, place orders from registered restaurant partners, and receive food delivered to their specified location.

By downloading, installing, registering, or using the Margo Deliveries mobile application ("App") or website, you ("User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not use the App.

2Eligibility & Account Registration

• You must be at least 18 years of age to use this App. Use by minors is prohibited without parental/guardian consent.
• You must provide a valid mobile number, email address, and accurate personal details during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to immediately notify us of any unauthorised access to your account.
• One person may not maintain more than one active customer account. Duplicate or fraudulent accounts will be terminated.
• Zae Food Private Limited reserves the right to refuse registration or suspend any account at its sole discretion.

3Use of the Platform

The App is provided solely for personal, non-commercial use. You agree NOT to:

• Engage in any fraudulent, abusive, or unlawful activity on or through the App.
• Place orders with no intention of payment or acceptance ("ghost orders").
• Manipulate, reverse-engineer, decompile, or disassemble any part of the App.
• Use automated bots, scripts, or scraping tools to access the App.
• Attempt to gain unauthorised access to any server, database, or network connected to the App.
• Post false reviews, defamatory content, or harass restaurant partners or delivery personnel.
• Resell or commercially exploit the App or any content therein.

4Ordering, Pricing & Payment

• All prices displayed on the App are inclusive of applicable taxes unless otherwise stated.
• You agree to pay all charges at the prices listed at the time of your order, including delivery fees, platform fees, or surge pricing.
• Payment must be made at the time of placing an order via supported payment methods (UPI, credit/debit cards, wallets, COD where available).
• GST and other applicable taxes are charged as per prevailing regulations and displayed separately at checkout.
• Zae Food Private Limited reserves the right to revise pricing, delivery fees, and platform fees at any time without prior notice.
• Promotional pricing and discounts are subject to terms of individual offers and may not be combinable.

5Delivery Services

• Delivery is provided within designated serviceable areas, currently Thane West, Maharashtra. Availability may vary by location, time, and partner restaurant operational hours.
• Estimated Delivery Times (EDT) are indicative only and are not a guarantee. Delays may occur due to traffic, weather, or restaurant preparation time.
• You must ensure someone is available at the delivery address. Failed deliveries due to user unavailability may not be eligible for a refund.
• Real-time GPS tracking is provided once your order is dispatched.
• Margo Deliveries reserves the right to cancel or modify orders if the delivery address falls outside the serviceable zone.

6Restaurant Partners

Restaurant partners are independent third-party entities. Zae Food Private Limited is not responsible for the quality, taste, safety, or allergen content of food, delayed preparation, or FSSAI compliance of individual restaurants.

7Promotions, Offers & Loyalty

• All discounts, coupons, cashback offers, and loyalty rewards are governed by individual campaign terms.
• Promotional codes are single-use unless otherwise stated and cannot be transferred.
• Zae Food Private Limited reserves the right to withdraw, modify, or discontinue any promotional offer at any time without liability.
• Abuse of promotional offers will result in disqualification and potential account termination.

8Intellectual Property

All content on the App is the exclusive property of Zae Food Private Limited or its licensors, protected under the Copyright Act, 1957. The "Margo Deliveries" name and logo are trademarks of Zae Food Private Limited. You may not reproduce, distribute, or exploit any content without express written permission.

9Disclaimers & Limitation of Liability

• The App is provided on an "as-is" and "as-available" basis without warranties of any kind.
• Zae Food Private Limited shall not be liable for any indirect, incidental, consequential, or punitive damages.
• Our total aggregate liability to any user shall not exceed the amount paid for the specific order giving rise to the claim.

10Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Disputes shall first be resolved through good-faith negotiation (30 days), then arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Thane, Maharashtra. Courts in Thane, Maharashtra have exclusive jurisdiction for non-arbitrable matters.

11Amendments & Updates

Zae Food Private Limited may amend these Terms at any time with notification via in-app notification, SMS, or email. Continued use of the App after any amendment constitutes acceptance of the revised Terms.
